Brownfield/Superfund Redevelopment

Our attorneys were actively involved in the creation of the New York State Brownfield Cleanup Program (BCP) Law and continue to provide advice during legislative amendments.

We have successfully navigated dozens of projects through the BCP process, ultimately helping clients achieve a Certificate of Completion, the associated liability release, and tax credits.  Knauf Shaw handled the first BCP case to be heard by the Court of Appeals, New York’s highest court, Lighthouse Pointe Property Associates, LLC v. NYSDEC, 14 N.Y.3d 161 (2010), where the NYSDEC decision to reject the site from the program was overturned, and Knauf Shaw’s client gained rightful admission into the BCP.

Knauf Shaw serves as counsel for numerous entities like developers, not-for-profits, low income housing developers, and municipalities for BCP and Superfund sites.  Notable sites are listed as Case Studies. Knauf Shaw has enabled clients to develop BCP and Superfund sites into  industrial, commercial, residential, mixed-use and public park projects, throughout all of New York State.
