Our zoning and planning experience includes site plan approvals, special use permits, variance relief and subdivision approvals, plus administrative and quasi-judicial proceedings before zoning, planning and other municipal boards. We also guide our clients through the federal National Environmental Policy Act (NEPA), where required, and State Environmental Quality Review Act (SEQRA) compliance.
As part of these environmental review processes, we assist the municipality, as well as our clients, in assuring that both the procedural and substantive requirements of these processes have been met through lead agency determination, scoping, the preparation of Environmental Assessment forms and Environmental Impact Statements (EIS), if required, and public participation.
Further, we prosecute and defend matters related to a land use decision through Article 78 or other legal proceedings when an arbitrary and capricious decision has been made by an agency or municipality.
