Potentially Responsible Parties (PRPs): We work with PRPs to evaluate whether a reactive or proactive corporate strategy is more appropriate for their portfolio of Brownfield sites given the applicable state Brownfield liability relief, risk-based cleanup standards and financing mechanisms presently available in the relevant state
National Real Estate Brownfield Disposition Advisors: We provide portfolios to a number of the top real estate institutional investors and lenders and advise these clients throughout subsequent acquisition or equity transactions. We are able to enter into creative flat fee arrangements at competitive rates to review and evaluate Phase I and Phase II site assessment reports and provide legal opinions on environmental risk for any due diligence matter.
Government Financing: We assist municipalities by identifying available grant or lending programs for Brownfield Redevelopment or Landfill Closure projects, and introducing such municipalities to not for profit or other real estate investors in order to facilitate the redevelopment of sites through the New York State Clean Water/ Clean Air Bond Act program, and a variety of federally funded Brownfield redevelopment programs.
Prospective Purchasers: We represent prospective purchasers of Brownfield sites by securing voluntary cleanup agreements with relevant State or federal agencies or indemnification agreements from current or prior owners. We also evaluate the potential of commencing a cost recovery action or Oil Spill Fund claim to recoup past or future cleanup costs.
